APPLICANT REQUESTS THAT:

His Fitness Assessments (FAs), dated 20 Dec 10, 30 Mar 12, 16 Jul 12 and 11 Oct 12 be declared void and removed from the Air Force Fitness Management System (AFFMS).

APPLICANT CONTENDS THAT:

He had a medical condition that precluded him from obtaining an overall satisfactory rating on the contested FAs.

His physician identified a thyroid condition that prevented him from passing the contested FAs.  Following treatment he was able to achieve a passing score.

On 16 Oct 12, the applicants commander issued a letter requesting the base physician determine if a medical condition was precluding him from attaining a passing FA. 

On 26 Oct 12, he was examined by a military physician and issued a letter indicating that he had a medical condition that precluded him from passing the contested FAs. 

Following his medical examination, his commander issued a memorandum requesting that the abdominal circumference (AC) portion of the contested tests be removed from AFFMS.

The applicant is currently serving as a Master Sergeant (E-7) in the Regular Air Force.

This request was considered and partially granted by the Fitness Assessment Appeals Board (FAAB) on 14 Feb 14.  The contested FAs were not entirely removed.  However, the AC component of the contested FAs was exempted.

The outcome of the FAAB advisory removing only the AC portion of the assessment is a passing score on the 20 Dec 10 FA. The additional three contested FAs remain unsatisfactory.  The applicants request is to remove the contested FAs entirely from his record.

AIR FORCE EVALUATION:

AFPC/DPSIM recommends partial relief of the applicant’s request to remove the contested FAs.  Based on lack of supporting documentation only the AC portion of the contested FAs is suggested to be removed/exempted.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation, with attachment, was forwarded to the applicant on 28 Feb 14 for review and comment within 30 days.  As of this date, no response has been received by this office (Exhibit C).

THE BOARD CONCLUDES THAT:

1.	The applicant has exhausted all remedies provided by existing law or regulations.

2.	The application was timely filed.


3.	Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant partial relief.  After thoroughly reviewing the evidence of record and noting the applicant’s contentions, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the contested FAs should not be declared void; however, the AC component scores should be changed to reflect an “Exempt” status.  In this respect, the applicant has provided documentation validating he had a medical condition which prevented him from passing the AC component of the FAs.  Specifically, we note the “Commander Invalidation Letter” requesting that the FAs be removed, the “Medical Determination Letter” from his medical provider, and his medical records indicating he had a pre-existing thyroid condition.  In view of the applicant’s medical condition, the recommendations from his commander and medical provider, we recommend the applicant’s records be corrected as indicated below.

THE BOARD DETERMINES THAT:

The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that the Fitness Assessments, dated 20 Dec 10, 30 Mar 12, 16 Jul 12 and 11 Oct 12, be amended in the Air Force Fitness Management System (AFFMS) to reflect that he was “Exempt” from the abdominal circumference components.
